Q: What should I do immediately after an accident?

A: When medical attention is needed, that must be a priority. If there are injuries, call 911 immediately. Exchanging information with the other driver is an important basic step. If possible, take photos of the vehicles damaged in the crash.

Q: What happens to my car? Who pays for it and for any rental car I may need?

A: This can only be answered on a case-by-case basis because it depends on several factors. One factor is what type of collision coverage you have on your own insurance. Another is what type of insurance coverage the other driver had – or, in the case of uninsured or underinsured drivers, did not have.

Q: Who pays for my medical bills when I’m injured?

A: In Pennsylvania, all automobile insurance policies have mandatory medical coverage of at least $5,000. Above that amount, personal health insurance applies; however, only after the underlying auto insurance medical coverage is exhausted.

Q: If I make an injury claim, will my premiums go up?

A: Not unless you were 51 percent or more at fault in an accident.

Q: What if I may have been partly at fault?

A: Pennsylvania is one of about 20 states that allow a person who was 50 percent or less at fault to still proceed with legal action against other responsible parties. Your recovery will be reduced by the degree to which you were at fault, but as long as you were not more than 50 percent at fault, you can go forward with your claim.
